Death by hanging. Robert Colvin Smith (died 12 May 1868) was the last person to be publicly executed in Scotland . On 1 February 1868, Smith, a 19-year-old labourer, encountered 9-year-old Thomasina Scott at the home of Jane Crichton in Cummertrees and offered to accompany her to Annan, where her mother had sent her to run an errand.

The case against his wife was found not proven—a Scottish legal verdict to acquit an individual but not declare them innocent. Burke was hanged shortly afterwards; his corpse was dissected and his skeleton displayed at the Anatomical Museum of Edinburgh Medical School where, as at 2024, it remains.

Mary Timney (died 29 April 1862) was the last woman publicly executed in Scotland. She had been convicted of the murder of her landlady Ann Hannah. Timney lived in Carsphad, three miles from St John's town of Dalry in a stone cottage adjacent to Hannah's house. The two of them argued regularly, and Hannah suspected Timney of stealing firewood.
